The Karnataka High Court on January 15 adjourned the hearing on a plea filed by former Chief Minister BS Yediyurappa seeking quashing of the Protection of Children from Sexual Offenses (POCSO) case against him. The hearing took place before Justice M Nagaprasanna, with senior advocate Ravi Varma Kumar representing the Criminal Investigation Department (CID). During the proceedings, the CID counsel presented details of the alleged incident and presented important evidence including a video and an FSL (Forensic Science Laboratory) report. According to the FSL report, Yediyurappa’s voice sample matches the audio in evidence.
Kumar also read out the report in the court and highlighted that the video evidence was verified by the National Forensic Sciences Department in Gujarat, confirming that it was neither tampered with nor tampered with. The senior advocate argued that the case cannot be dismissed on the basis of statements of witnesses recorded under Section 161 of the CrPC, which allows police officers to interrogate people who provide information about a crime. Be able to and cite relevant Supreme Court decisions in support of your argument. The court adjourned the hearing till January 17 and extended the interim order granting bail to Yediyurappa and exemption from appearing before the trial court.
The case against the BJP leader came to light after a woman complained that Yediyurappa molested her 17-year-old daughter at his Bengaluru residence in February 2024. The woman died of lung cancer in May that year. The sexual harassment complaint against Yediyurappa was filed in March 2024. However, citing alleged police inaction, the victim’s brother filed a fresh petition in June, demanding Yediyurappa’s immediate arrest and interrogation.
