The Rouse Avenue Court of Delhi reviewed the case and decided to quash the summons order issued by the magistrate court. The decision has come as a legal victory for Atishi, who challenged the validity of summons in his petition.
A Delhi court dismissed the defamation of the BJP leader against the Chief Minister and Aam Aadmi Party (AAP) leader Atishi. Atishi was summoned in connection with the case. The case was filed by BJP spokesperson Praveen Shankar Kapoor. It was alleged that the Chief Minister’s statements regarding the alleged efforts to break the AAP MLAs by the saffron party had damaged his personal and party’s reputation. In the court, Kapoor had argued that the allegations were baseless and infinite.

The decision has come as a legal victory for Atishi, who challenged the validity of summons in his petition. Special Judge Vishal Gogane gave this order on the appeal filed by the AAP leader. Justice Gogne noticed the plea of Atishi’s lawyer that he did not discredit Kapoor because the alleged defamatory statement was against the BJP, not against anyone.
In a statement last year, Atishi allegedly claimed that 21 MLAs of the Aam Aadmi Party (AAP) were contacted by the BJP, who offered him Rs 25 lakh to each to join the saffron party. During the same program, Atishi also alleged that the BJP had approached him to join otherwise he would be arrested by the Enforcement Directorate in the coming days.
