A special bench has been formed by Chief Justice Sanjeev Khanna to hear the interim bail plea of accused Tahir Hussain in the February 2020 case involving the death of Intelligence Bureau employee Ankit Sharma. The bench of Justice Vikram Nath, Justice Sanjay Karol and Justice Sandeep Mehta in the Supreme Court will hear Hussain’s bail plea on January 28. AIMIM candidate Tahir Hussain from Delhi’s Mustafabad seat has sought interim bail for the election campaign for the upcoming Delhi assembly elections.

Assuming that the right to contest the election is not a fundamental right, Justice Mithal said that the permission of interim bail could open the box of Bhanumati as every under consideration will apply on this basis.
If interim bail is allowed for the purposes of contesting elections, it will open the box of Bhanumati. Since elections are held throughout the year, every under consideration will bring the argument that he wants to participate in the election and hence he should be granted interim bail. This will open the doors of floods, in which our opinion cannot be allowed. On 14 January, the Delhi High Court gave Hussain parole in custody for filing nomination papers from Mustafabad constituency on AIMIM ticket.
